Mobile :- No Roaming Charges

Speaking to the media on the sidelines of the curtain raiser event of India Internet Governance Conference,Telecom Minister Kapil Sibal on Monday announced that mobile phone subscribers will not have to pay roaming charges from next year.


"From next year. Our secretary has told you that it will be free from next year," Sibal said in New Delhi in response to a query on the timing of removing roaming charges as proposed in the National Telecom Policy 2012.

NTP 2012, approved in May, aims to abolish roaming charges and allow mobile phone subscribers to use same number across country without having to pay extra charges for services once they are outside their telecom circle.

Meanwhile, Telecom Secretary R Chandrashekhar said the Department of Telecom (DoT) is working on Notice Inviting Applications for spectrum auction after which it will work on unified licence (UL) guidelines - also a part of the NTP 2012.

"We are first going to attend to all issues linked to auction. The moment NIA is issued this week, we will focus on UL. After details of full UL is worked out, the modalities for free roaming will follow," he said.

As per the schedule, NIA will be issued on 28th September.

GSM industry body COAI Director General Rajan S Mathews said he appreciated the concept of free roaming, but added that industry will have to work on details of implementation of 'One Nation - Free Roaming'.

When asked about the impact on mobile phone call rates, Mathews said, "That is matter which we will have to work with Trai (telecom regulator). Trai is ultimately responsible for setting the tariffs...We hope that Trai will follow due process of consultation paper."

He added that in a consultation paper, the Telecom Regulatory Authority of India will define what they expect and models they will use for determining tariff for nation wide free roaming.

Mobile:- Vodafone was Warned

CBDT CLARIFIES "VODAFONE WAS WARNED"
PRESS RELEASE, DATED 2-5-2012


A news report has appeared in the Financial Express, Delhi edition, 27th April, 2012 captioned "I-T didn't warn Vodafone of tax burden or dispute deal format". In this regard, the Central Board of Direct Taxes (CBDT) has issued the following clarification:-

In this connection, it may be noted that the first notice in the transaction relating to sale of 66.9848% stake of Hutchison Essar Ltd. (HEL) was issued on 15th March, 2007 under section 133(6) of the Income-tax Act, by the Additional Director of Income Tax (International Taxation), Mumbai to HEL in which it was asked to submit certain details regarding the transaction including shareholders agreements and memorandum of understanding between Hutchison Telecommunications International Ltd. and Vodafone Group dated 11th February, 2007. In the said notice, it has been clearly mentioned that as per information available (from Press Releases of the parties concerned), Vodafone International Holdings BV proposes to acquire the entire issued share capital of CGP Investments (Holdings) Ltd., a company incorporated in Cayman Islands indirectly from HTIL and the full details of the transaction was sought.

When the Indian company showed its inability to submit the details, another notice was issued on 23rd March, 2007 in which, after quoting the Press releases from HTIL and Vodafone, it was mentioned that HTIL/Hutchison Group had made substantial gains from their investment in HEL. It was clearly mentioned that the capital gains are chargeable to tax in India. It was further mentioned that if in case, parties to the transaction proposes to advance any other view, they are at liberty to approach the Assessing Officer. It was explained that the payer (Vodafone Group) as well as the payee (Hutchison Telecom Group) can make an application to the Assessing Officer under sections 195(2) and 197 of the Income-tax Act, 1961, respectively for determining the exact tax liability resulting from the above-mentioned transaction.

This advisory of the tax department was conveyed to the parties concerned, that is, to Vodafone Group and to HTIL. This has been confirmed by HEL in writing through their letter dated 5th April, 2007. It has been mentioned by HEL in the said letter that "we have provided copies of this letter to the concerned parties" and that this has been done solely on the request of the tax department and without assuming any responsibility or liability whatsoever for any actions and transactions of the two non-resident entities.
HEL had its principal office at Mumbai but was assessed to tax at Chandigarh. The Assessing Officer at Chandigarh, on 28th March, 2007, had written two letters to HEL, one of which was addressed to Vodafone UK in which attention of provisions of section 195 was drawn. Replies to the two letters were provided on 1st April, 2007 in which it has been stated that the letter addressed to Vodafone UK is being returned. These correspondences had no relationship with the enquiry conducted at International Taxation Directorate, Mumbai, which had the jurisdiction over the said transaction.


The facts stated as above indicate that while the communication sent by Chandigarh tax office was not served on Vodafone UK and thus has no relevance, the notice sent by Mumbai International Taxation Directorate was confirmed by HEL, India, to have been served on both HTIL and Vodafone.

Thus, Vodafone cannot say that it had received no communication from the tax department, about the chargeability of the transaction to tax in India. Further, it chose to ignore the advice, received before the conclusion of the transaction, that Vodafone or HTIL should approach the Assessing Officer under sections 195/197 of the Income-tax Act, 1961, for determining the exact tax liability in India.

It is clarified that the above communications are part of the Court records and are thus in the public domain.

TRAI/DND/Register DND or De-Register DND mobile SMS services

       Telecom Regulatory Authority of India (TRAI)  has stopped to all SMS service provider to send commercial  SMS to those numbers who are registered in DND.   Group SMS is also restricted by TRAI.  In the interest of customer , it is necessary to know how a customer or phone user can Register himself for DND (Do Not Disturb) service or De-Register for DND service. 


Registration Process :-


Register for DND Service            Dial or SMS to 1909 (toll free)
                                                   example of SMS write START DND and send it to 1909

De-Register for DND Service      Dial or SMS to 1909 (toll free)
                                                   example of SMS write STOP DND and send it to 1909

SMS for Registration                   a) write "START  0" and send it to 1909 for fully blocked category.
                                                   b) write "START" and send it to 1909 for one or multiple options from
                                                          the list of seven categories.
List of Seven Categories            

  1. Banking/Insurance/Financial Products/Credit Cards-1,
  2. Real Estate-2,
  3. Education-3, 
  4. Health -4, 
  5. Consumer goods and Automobiles-5, 
  6. Communication/Broadcasting/Entertainment/IT-6,

(Example :- for Starting SMS from Banking/Insurance/Financial Products/Credit-Cards  write 'START 1' and send it to 1909.)

on successful registration, customer will receive an SMS for confirmation of registration alongiwith Unique Registration Number with in 24 hours. Registration process take time for 7 days and customer can check his registration status at any time.  "Check Registration Status  Here"

In case customer feels that there is no effect of registration with in 7 days , he may also lodge complaint through dialing 1909 or through SMS to 1909.  



  • Customer has to send SMS  COMP Tel No  xxxxxxxxxx, dd/mm/yy, Time hh:mm to 1909. 
  • Value of xxxxxxxxxx stands for Telephone Number or header of the SMS,
  • Action on your complaint will be taken within 7 days of lodging of complaint and customer can  "Check UCC Complaint Registration Status  Here"

200 Mobile SMS from one Sim

It is good news for Mobile users that TRAI has extended the limit of 100 SMS per day per SIM to 200 SMS per day per SIM.  Earlier  a limit of SMS was fixed only 100 SMS per day per SIM, now it has been increased by TRAI  to 200 SMS per day per SIM.

TRAI extends the 100 SMS per day per SIM limit to 200 SMS per day per SIM. 

New Delhi, 1st November, 2011:  All the provisions of  “The Telecom Commercial Communications Customer Preference Regulations, 2010” issued have come into force from 27th  September 2011.  

2. The Telecom Commercial Communications Customer  Preference Regulations  provide a restriction that no Access Provider shall permit sending of more than one hundred SMS per day per SIM except telemarketer or transactional message sending entity. The Authority has received representations from some of the service providers and consumers to increase the limit of 100 SMS per day per SIM. The Authority has considered these representations and decided to increase the limit of one hundred SMS per day per SIM to two hundred SMS per day per SIM. 

3. The  “The Telecom Commercial Communications Customer Preference Regulations, 2010” and Direction are available on TRAI website http://www.trai.gov.in.

Free Roaming in India on Mobile

It is good news for Mobile users that mobile portability in India will be free.  Earlier this facility is available only in region.  Now telecom operators can use a single licence for operations in various parts of the India.   There will be no difference between Local and STD calls, as the Policy aims at a 'One-Nation-One-Licence' regime. 

Hon'ble Telecom Minister Kapil Sibal has said that "We will seek Telecom Regulatory Authority of India (TRAI) recommendations on new licences, migration to new licences and exit pocliy." while releasing the draft policy. 

In the wake of the 2G scam, the minister said spectrum allocation would be delinked from licences and radiowaves would be made available at market-determined prices.


As the market is crowded with too many players, the government would also bring an exit policy.



With regard to spectrum, Sibal said the government would provide a roadmap for additional spectrum availability every five years and also make its periodic audit mandatory to ensure that the scarce resource is used efficiently.



The draft NTP has also set an ambitious target of providing broadband services on demand by 2015 with a target of 600 million such high-speed Internet connections by 2020.



The draft NTP has went to the extent of likening the broadband connectivity to basic necessities like health and education and proposes to work towards a 'Right to Broadband' for every citizen.



The policy has also called for providing by the year 2015, the 'Broadband on Demand' services, which would enable affordable, across-the-country, round-the-clock and high-speed Internet connectivity to the users.



"The primary objective of National Telecom Policy (NTP)-2011 is maximising public good by making available affordable, reliable and secure telecommunication and broadband services across the entire country," Sibal said.



The draft NTP-2011 aims to achieve 175 million broadband connections by the year 2017 and 600 million by the year 2020.



It also aims to converge mobile telephony, multimedia and broadcast services, to offer superior experience to customers.



"We want to reposition the mobile phone from a mere communication device to an instrument of empowerment that combines communication, with proof of identity, fully secure financial and other transaction capabilities, multi-lingual services and a whole range of other capabilities that ride on them and transcend the literacy barrier," Sibal said.(ST-10/10)

Draft Policy on Mobile Governance by Income Tax Department

New Delhi, Apr 5 (PTI) The Department of Information Technology (DIT) has published a draft policy on mobile governance that aims to enable government departments to provide services, including payment of utility bills and filing of tax returns from mobile phones.

A platform called Mobile Service Delivery Gateway (MSDG) will be set up, on which all ministries and departments will be able to start their services, according to the document posted on the department''s website for public comments.

The DIT expects to develop the gateway by September this year and link projects that have already been digitised, such as filing of income taxes, by December.

There are about 80 million Internet users in the country, while the number of mobile phone subscribers was around 771 million at the end of January, according to the Telecom Regulatory Authority of India.

"The relevance of the mobile platform as a medium for delivery of public services is also evident when we compare the subscriber base of mobile phones to that of the Internet," the consultation paper said.

The policy will also lay down the framework for a common payment gateway and make sure that all government departments follow the same standards.

"The application providers will be encouraged to adopt these standards to ensure the inter-operability of the applications across various systems and devices to the extent practicable," the document said.

DIT has also proposed to set up an innovation fund to provide funds to third-party developers to build software applications on the gateway. The size of the fund has not been decided yet.

SMS Based Service for Challan Status

              Before knowing Sms based service for challan status,  we should know what is challan status.   A deductor who deduct tax and deposit tax via e-payment for in bank, requires to know the status of his challan.  In this way, before filing any etds/etcs return it is necessary to check the status whether the deposited amount has been properly accounted in your TAN number for not.  Lot of time  I have found that amount deposited by deductor in bank  do not display in his TAN number during the enquiry of challan status. Mobile Numbers Portability

                Now, implementation of portability of Mobile Numbers has been extended upto 31-October-2010. Mainly all networks technically upgraded and ready to convert their numbers to each others. For example if you using a mobile with airtel connection and want to change due to change in services in BSNL, there will be no need to change mobile number. Your mobile number will not be changed with BSNL services. It will be beneficial for Mobile users. The below information has been given by the Minister of State for Communications and Information technology, Shri Sachin Pilot in written reply to a question in Rajya Sabha today. 

             All the networks in the country have been technically upgraded for implementations of Mobile Number Portability (MNP) Service and the network of Mahanagar Telephone Nigam Limited (MTNL) is in the process of upgradation. However, the readiness of networks can be ascertained after comprehensive testing of networks which is being conducted across all the networks. Government is regularly monitoring the status of implementation of MNP including readiness of the networks. All the networks of the Access Service Providers in all the service areas and International Long Distance Operators (ILDOs) in the country have to be ready and tested for satisfactory performance in post MNP implementation scenario before the MNP Service is commercially launched. In case, any of the networks is not ready and MNP service is launched, it will not be possible to make calls from that network to ported numbers of other network.

               The Government had set the time line for implementation of Mobile Number Portability (MNP) Service as 31st March 2010 in the month of December, 2009 which was further extended to 30th June 2010. The whole network {all Access Service Providers in all service areas and International Long Distance Operators (ILDOs)} in the country have to be ready and tested before the MNP Service is implemented. Keeping the complexity and enormity to the testing involved before MNP is implemented and keeping in view of the status of implementation by various operators in the month of June, 2010, Government has extended the time line for implementation of MNP to 31st October, 2010.
